El presente artículo de reflexión es el resultado de una investigación que tuvo un enfoque metodológico cualitativo que se expresó en dos dimensiones: uno analítico-conceptual y otro crítico-hermenéutico, y está dirigido primordialmente a examinar el problema de la obediencia moral al derecho desde los presupuestos teóricos y conceptuales de la ética normativa. Sosteniendo como tesis principal que la ética no puede equipararse a una moral aplicada, en la medida que esto implicaría confundir la ética con la moral y por el (...) contrario, el cumplimiento de las normas se da por ser lo moralmente correcto, en consecuencia, será posible concluir a través del presente trabajo que existe una obligación moral de cumplir el derecho, salvo juicios morales concretos frente a ciertas regulaciones de conductas establecidas por normas que no estén acorde a los valores críticos o morales. Para tanto, propõe-se um percurso pelas principais ideias do feminismo acerca do poder surgidas a partir da década de 1960, nas quais esse aparece relacionado, principalmente, aos conceitos de dominação e opressão, mas também às visões sobre empoderamento, recurso, cuidado e liberdade. Austin introduces the idea of securing the uptake in the context of dealing with the illocution-perlocution distinction. In recent times, the notion is employed by some neoaustinian scholars to argue that the uptake is what triggers the deontic effects (rights, duties, obligations, permissions, etc.) associated to an illocution. Here, a distinction is made between two kinds of uptake: uptake-as-understanding and uptake-asaccepting, and the stance that the second is the one needed for a plausible theory of speech action inspired by Austin’s (...) original ideas is defended. Se presenta aquí la tesis que sirve de hilo conductor a los trabajos agrupados en este monográfico doble: los nuevos sujetos políticos en la postmetrópolis. En primer lugar, se señala la vinculación de la política con la realidad urbana en la que se crean los sujetos políticos. En segundo lugar, se analizan las ciudades actuales, en las que vive ya más de la mitad de la población mundial, y se muestra cómo su funcionamiento las convierte en realidades diferenciadas respecto a (...) ciudades y metrópolis previas. Con un enfoque multidisciplinar se investigan las características, problemas y retos sociopolíticos más destacados a los que se enfrentan quienes habitan estas realidades urbanas, cuyo rasgo fundamental es que son ciudades inteligentes. Consciousness can, therefore, be located anywhere and everywhere, but in a form that we do not understand until it takes shape within the limits of our reality. Fractals are built from patterns generated from immense complexity within the resonant frequencies that connect and tune the universe. Play of such frequencies would result in the exchange of energy and coupling of informational systems at various levels and scales. The present essay serves as a small ride into life’s association with such phenomenon. At a fundamental level communication happens via process called ‘resonance’, and this in turn manifests at a physical level as self-replicating and self-resonating patterns called ‘fractals.’ This (...) could be the reason why at a physical level every structure carries this fractal imprint nature, making it the cosmic signature. The fractal patterns popping out in the natural world surrounding us could be thought of as frozen energy or resonant life patterns. Thus, we hypothesize life could have emerged or appeared as a ‘fracto-resonant’ phenomenon, resulting from the play of interference between material and non-material aspects. In this regard, we propose frequencies or vibrations to be more fundamental to life and call for scientific studies that aim at understanding the effect of various frequencies and vibrations on life forms and consciousness. The present mainstream science tackles the problem of Consciousness by embracing the objective or third person perspective; hence, it fails in understanding many fundamental aspects of life. Further, knowledge gained from science is not absolute in the sense that it is based on a human-centric view. This brings us to the question of how to access absolute reality? In this article, we consider the subjective aspect associated with the objective phenomena and explore a possible new science of subjective experience.

A given explanatory theory T falls into circular reasoning if the only way to determine its explanandum is through the application of T. To find an underlying theory T′ that determines T′s explanandum helps us save T from this accusation of circularity. We follow the structuralist view of theories in presenting and dealing with this issue, by applying it to particular theories. More specifically, we focus on the relationship between the Darwinian theory of common ancestry and the determination of homologies.

The purpose of this research is the analysis of a specific cultural and political tension, through two decisive concepts: imagocracy and imagomaquia. Our aim is to define the political battlefield in the arena of audiovisual communication. In the case of Latin America, we have identified two significant moments, in which the popular audiovisual strategies had crucial importance. Our material of research has been both the New Latin American Cinema and the sociology of the decolonial image. We have studied them in (...) depth in order to define the effectiveness of popular audiovisual strategies as nuclei of creation and aesthetic-political resistance, which opposes the hegemonic audiovisual order. This paper aims to analyse a set of communicative events within the service encounter genre in tourism and leisure interdiscursive domains as displayed in course books on professional communication in English (commonly pointing to ESP). These supposedly replicate interaction in real life settings. Therefore, it is relevant to uncover the ways authentic interactions can be interpreted in the pedagogical setting of workplace conversation from a discursive and pragmatic perspective. More specifically, this empirical and exploratory study discusses ways of improving rapport (...) management skills in interpersonal and intercultural communication, in general, and in professional interaction, in particular, in a selection of excerpts on greeting / asking for info exchanges. The study uncovers participants’ possible co-constructions of civility and politeness strategies in naturally occurring classroom discourse supported by course materials in English for glocal communication across segments in the tourism domain as object of this study. This paper investigates Philomela's metamorphosis into a swallow as inferred from Sophocles’ fragmentary Tereus. The first part focusses on the association between the swallow and barbaric language, casting new light on Philomela's characterization in the play. The second investigates the shuttle, the weaving tool which prompts the recognition of Philomela, arguing that the mention of its ‘voice’ in fr. 595 Radt refers not only to the tapestry which it created, but also to the actual sound of the shuttle, which ancient (...) Greeks associated with the swallow, and thus anticipates Philomela's metamorphosis. The representation of Philomela as a speech-impeded and yet vocal character supports the Dionysiac background of the act of vengeance which she and her sister commit. (shrink)

“Democratic Ethical Life and the Struggle for Recognition: AReconstruction of Hegel’s Inluence on Deliberative Democracy”. Hegel’s politicalphilosophy represents a signiicant contribution to the understanding of moderndemocracy and social dynamics. As regards modern democracy, the concept ofdemocratic ethical life presented by Wellmer allows for the integration of equalsubjective rights and citizen participation in a deliberative culture that illsdemocracy with citizen vitality without going against individual liberties. As forsocial dynamics, they can be explained by the need for reciprocal recognition asthe key to (...) the constitution of subjectivity, which explains the moral motivation inthe struggles of social groups. Both concepts are closely interwoven because thestruggle for recognition allows for an explanation of the dynamics of democraticethical life. Thus, democratic ethical life and the struggle for recognition, asinterwoven concepts, offer two key notions for the solution of some of the obstacleswith which contemporary political philosophy must deal. Upper echelons theory posits that organisational performance reflects the personal values and cognitive frames of the top management team and, crucially, that greater heterogeneity in individual backgrounds of senior executives leads to better outcomes. However, often missing from this research is a more developed account of how this relationship between the characteristics of TMTs and performance is also mediated by internal conditions within organisations. In this paper we begin to address this deficiency focusing on the mediating impact of employee satisfaction (...) and the styles and practices of line managers. Looking at the empirical case of English National Health Services acute care hospital trusts, we use a multiple mediation model to analyse the relationship between board heterogeneity, performance and these two organisational factors. A variance-based structural equation modelling approach is applied to a sample of 102 boards of directors. First, the results lend support to the UE hypothesis that there is a positive impact of board heterogeneity and hospital-level performance. Second, the analysis shows that the relationship heterogeneity–performance is positively influenced by: the styles and practices of line managers; the levels of staff satisfaction; and by their mutually reinforcing roles. Background Ethical conflicts generate difficulties in daily clinical activity. Which methods of ethical advice are most frequently used to resolve them among Spanish doctors has not been studied. The objective of this study is to describe what methods hospital internal medicine physicians in Spain use to resolve their ethical doubts and which they consider most useful. Design A cross-sectional observational study was conducted through a voluntary and anonymous survey and distributed through an ad hoc platform of the Spanish Society of (...) Internal Medicine. Measures We measured methods by which to resolve doubts, types of tools sought, frequency of consulting the Clinical Ethics Committees, and satisfaction with resolution of ethical issues. Results Of 261 internists surveyed, 86 per cent resolve their ethical doubts with assistance, the most frequently used method being consultation with colleagues (58.6 per cent), followed by using specific protocols or guides (11.8 per cent) and consultation with experts in bioethics (9.6 per cent). The most preferred tools are the creation of protocols (30.3 per cent) and the establishment of a consultant/expert in bioethics (27.8 per cent). Conclusions Internists in Spain usually seek assistance to resolve their ethical doubts. Consulting colleagues is the most frequently adopted method. The majority regard tools to resolve ethical conflicts as necessary, seeking above all protocols and consultants/experts in bioethics. (shrink)

¿En qué consistiría una filosofía de la universidad? ¿Cómo esbozar el modo en que ésta puede proceder? ¿Qué puede decir hoy la filosofía para quienes trabajan en esta institución? Para responder estas preguntas se propone revisar algunos de los textos en los que el pensador de origen argelino habla de manera directa sobre la universidad: Las pupilas de la Universidad, La Universidad sin condición y Cátedra vacante: censura, maestría y magistralidad. Los tres textos fueron escritos para ser leídos en público (...) como lecciones inaugurales o conferencias. La tesis de este artículo es que una filosofía de la universidad debe asumir que esta institución es el lugar en el que todo debe ser cuestionado y debe reflexionar críticamente sobre las metáforas que se usan para referirse a su razón de ser, su esencia y fundamento. Para desarrollar la idea central el artículo se organiza en cuatro partes: primero, se revisa el modo de proceder y las preocupaciones generales, a partir de la relación que se puede establecer con elementos de dos textos de Martin Heidegger; segundo, se examina las metáforas sobre la visión y la luz; tercero, se reflexionará sobre la destinación y razón de ser de la universidad; por último, se tratará la pregunta ¿quiénes somos nosotros en esta corporación de profesores y alumnos? Just as religion is impassable to its own dogmatic philosophies and ideas, present day science also acts in the same manner. Embracing its reductionist approach, it loses its sight to the most beautiful and insightful possibilities associated with the cosmos and its fundamental constituents around us. The present paper is a holistic ride into few of life’s beautiful constructs that occur as a playful act of the cosmos, and in part hypothesize that the dynamic biological structures or forms could be (...) thought of as frozen energy patterns. Here, the supposition is that the electromagnetic fields that envelop our ecosystems play a central role in its functioning and evolution acting as a unified network interconnecting life at various scales. Supporting a synergetic and holistic view, the present paper is skeptical about the present school of thought, and to other investigations carried out under the sheath of modern science by raising a few fundamental questions. Content nonconceptualism and State conceptualism are motivated by constraints of content-attribution that pull in opposite directions, namely, the so-called cognitive significance requirement and what I would like to call here the same representing constraint. The solution to this apparent contradiction is the rejection of the real content view and the adherence to what I call here Content-pragmatism. In CPR, “proposition” is not as real as a mental state, but rather is a term of art that semanticists use, as a matter (...) of theoretical convenience, to classify mental states. What follows from CPR is Content-pluralism : there is no such a thing as the content of experience. Because both criticisms and the defense of SNC overlook CPR and CP, they are ineffective. In this paper, I will argue that the opposition between SNC and CNC is a real one, but only a relative one, that is, relative to the opposite constraints to be met, namely CSR and SRR. If we want to meet CSR, the best we can do is to let the content of experience be modeled as neo-Fregean content, namely a compound of non-conceptual modes of presentation of objects and properties. In this case, CNC prevails. In contrast, if we want to meet SRR, the best we can do is let the content of experience be modeled either as a Russellian compound of objects and properties or as a function from possible worlds to truth-values. Legal philosophers share the same phenomenology of legal practice. Yet, they differ in its explanation. For normativists, descriptivists got it wrong and vice versa. This controversy between normativists and descriptivists will be called “the methodological problem” in legal theory. Normativists such as Dworkin and Perry argue that descriptivists need evaluation. By contrast, descriptivists such as Coleman argue that normativists need the methods of descriptivism such as conceptual analysis and therefore might be committed to descriptivism. The paper shows that the responses (...) of Perry and Coleman to the methodological problem are not free from difficulties. The article also advances a reinterpretation of normativism in terms of two tenets: 1. the semantic sting argument, and 2. the ametaphysical thesis argument. If the latter argument is sound, normativism is unavoidable, because if there cannot be an external point of view or Archimedean perspective, then we can only resort to our moral convictions or substantive claims. The first tenet has been criticized in previous work and the paper focuses on a criticism of the second tenet. (shrink)

It streams limitless within the patterns of regimented matter, gratifies the body until it can fill it no more, but remains as a swirling ball of energy with it. It abides the laws of nature and so departs the body upon death to be transformed and reutilized. Cosmic energy shapes matter and so shapes life; fabricates the mind and the soul; makes the body conscious of its presence. To seek it, we need to imagine it; imagination helps us see within the stores of the cosmic energy matrix. For no matter what, the soul exists, it is no extraordinary form, no mysterious form; a sphere of energy; pure, created with the purposefulness of engaging life in forms that can support it; us; to experience the magnificence of what is and why it was created. The creator is the symmetric light which gave rise to asymmetric matter along with abundant cosmic energy that currently resides in the matrix of the universe; for the symmetry was broken with the big bang to create the universe. In the physical world, matter gave rise to biological structures to possess the electromagnetic soul and its processes; a localized form created of the cosmic (...) energy; in religion what we call the Spirit. Matter if corrupted or altered, leads to an imbalance in the life processes which can be healed with support from the eternal cosmic energy, as a healer for the soul. God is light; and in him there is no darkness (John 1: 1-5); for the creation was created of this light; filling the cosmos with the Spirit. The word soul in the cell-soul pathway does not have a scientific definition but has been hypothesized to be an indefinite, non-structured, massless energy made up of electromagnetic radiations that is confined in the cytoskeletal network of a living cell. It is a coherent, imperceptible, uncontainable and recyclable support pathway, which uses energy to promulgate consciousness in the cell supporting its functions. The pathway currently provides a mechanistic explanation of the flow of consciousness within the body, but the intent of (...) this paper is to provide an arduous explanation of non-local consciousness or disembodiment observed in near-death experiences. The paper hypothetically subsets the cell-soul pathway with the presence of two forms of consciousness, consistent with a recently developed model by Reddy : bodily consciousness, which manages functions only at cellular level, and functional consciousness, which is present in the body but can get disembodied and perform non-locally; the two forms of consciousness represent the overall state of consciousness. The non-locality of subjective experiences observed in near-death cases can be related to the realm of quantum physics – quantum entanglement between the two forms of consciousness that can demonstrate the capability of storing information holographically within the void or vacuum with the ability to create memories beyond the limitations of the brain and body. In this paper, we argue on the ability of science to capture the true subjective experience of life, blinded within the limits of its reductionist approaches. With this approach, even though science can explain well the physics behind the objective phenomenon, it fails fundamentally in understanding the various aspects associated with the biological entities. In this sense, we are skeptical to the present approach of science and calls out for a more fundamental theory of life that considers not only the (...) objectivity aspect of a biological entity but also the subjective experience as well. It raises questions as to what does it takes to develop a new science from a subjective standpoint. (shrink)
